ABSTRACT

 

The tide of judicial activism in environmental litigation in India symbolises the anxiety of Courts in finding out appropriate remedies for environmental maladies. At global level, the right to live is now recognise as a fundamental right to an environment adequate for health and well-being of human beings. decisions in India are particularly worth examination. In India, there is no statutory compulsion to gave an environmental assessment with public participation while a development project is being designed or approved although such assessment is claimed to be made by the concerned agencies within the Government. This position had its impact upon the judicial approach towards environmental questions.
